A Unique Perspective

With over 40 years of combined service in the military and telecommunications industries, I bring a unique perspective to real estate matters (see my resume below). It is my view that the primary focus of a real estate agent should be helping his/her customer or client to achieve their goals. I prefer to employ a casual, low-key, approach to agency representatioin. Personal Real Estate Policy

 

Subject to revision, below are ten moral, operational or administrative policies which guide my conduct as a Colorado Realtor: 

 

1.  Courtesy and Integrity.  First and foremost, I will conduct all transactions with my clients and customers in a courteous, honest, fair and straightforward manner, respecting their desires, goals, directions and decisions so long as, in my opinion, such intentions and actions are lawful and honorable. In all my actions I will adhere to the Code of Ethics promulgated by the Pikes Peak Association of Realtors.

 

2.  Fiduciary Responsibility.  I will conduct my affairs with all my clients (buyers or sellers under agency contract) and customers in both a responsible and accountable manner, acting as their agent or assistant, and placing their lawful interests above my own.

 

3.  Communication.  I will attempt at all times to communicate with my customers and clients in a clear, polite and precise manner so that my information, direction or guidance is understood.  

 

4.  Professionalism.  I will conduct myself and my real estate transactions at all times with professionalism. I recognize that it is my responsibility as a licensed Colorado real estate broker to guide, direct, inform, protect and assist my clients and customers to make wise selling or purchasing decisions, in accordance with accepted real estate ethics (as a Realtor) and the statutes, rules and regulations of the State of Colorado and the Colorado Real Estate Commission.

 

5.  Effort vs. Buyer Agency.  I will freely correspond with customers without limit prior to, during or after any personal showing of property, by either telephone, email or letter, and will gladly provide a variety of property information. I will also arrange for an initial showing of properties at the buyer's convenience. Thereafter, at my discretion, any repeat or additional showings of properties, research and investigation, property previews or other actions on my part may be accomplished after a Buyer agency or Transaction Broker relationship has been established and documented.

 

6.  Commissions.  Commissions based on a percentage of the selling price of properties I have transacted are how I make my living. I will communicate my commission rate up front during all agency negotiations. I will also establish flat fee rates for certain lower-priced properties. I will not, with few exceptions, agree to represent selling customers or clients at a discounted commission rate. Rather, I will make every effort and use all reasonable resources at my disposal to earn my commission by assisting my clients and customers to achieve their real estate goals (buying or selling) in an efficient, professional and exemplary manner.

 

7.  Foreclosures; Government or Lender-owned Properties.  I will not conduct transactions to purchase properties actively involved in the foreclosure process. However, I will conduct transactions for the purchase of properties in pre-foreclosure, which are involved in short-sale situations or which are offered for sale on the market after foreclosure or repossession.

 

8.  Phone Calls and Emails.  I will respond to all email inquiries, and all phone calls where a voicemail message is left, within twenty-four (24) hours or less.

 

9.  Other Agents.  I will honor the relationship my customers may have with other real estate agents.

 

10. Reservations Disclosure.  I reserve for myself the absolute and personal right to choose whether or not to represent any customer or client in any real estate transaction, to enter into any agency agreement or to terminate any such agency agreement or relationship at any time and for any reason involving (on the part of a customer or client) dishonesty, unethical practices, unlawful actions or instructions, disrespect, threats, personal or personality conflicts or failure to honor verbal or written contractual responsibilities and obligations.

David Martinek has 38 years of management and leadership experience in the cable television and telecommunications industries. He is also a retired U. S. Army Signal Corps officer. 

 

David has held executive positions at the division level of large cable television MSOs (Multi-System Operators), and senior manager positions with various cable and telecommunications companies. He is a decorated Vietnam veteran and has served on active duty in both Europe and Southeast Asia. Upon leaving active military service, he helped launch a startup master antenna television (MATV) company in Georgia, an experience which led to his 24-year cable television career in system management and public affairs.  

 

David attended the University of Missouri before entering military service. In addition, he attended several military schools, including the Army’s Command and General Staff College.

 

David lives in Divide, Colorado. His wife, Marcia, is editor of the Leadville Herald-Democrat newspaper. He has two grown children, a stepson and four grandsons.
